Attempted murder charge filed in man’s try to push woman in front of Oakland BART train

OAKLAND — An ex-convict  suspected of trying to deliberately push a woman in front of a BART train Saturday at the Lake Merritt Station has been charged with attempted murder, according to authorities and court records.

The victim, a woman in her 50s, fell on the yellow caution strip on the platform close to the track way and the operator of an approaching train saw her being  pushed and activated the emergency stop on the train, court documents say. The woman was uninjured.

The suspect, Tu Do, 44, of Oakland, is being prosecuted under three-strikes statutes.  He is being held without bail at Santa Rita Jail.

Authorities said the unprovoked attack happened about 5:30 p.m. Saturday. The woman did not know Do, authorities said.

Authorities said Do waited for a train to approach the platform before pushing the woman from behind toward the track way. The woman fell on the yellow caution strip on the platform and was kicked by Do, authorities said.

Do tried to flee but was arrested a short time later.

He was identified as the suspect by the victim and at least one other witness, the documents say.

According to court documents, Do has a prior felony conviction in July 2010 for assault upon a peace officer or firefighter in San Francisco that  he received probation for and a January 1996 felony conviction for assault with a deadly weapon in Alameda County that he went to prison for.
