OAKLAND — A suspected illegal gun dealer, who accidentally shot himself in the leg on March 13 inside his home while his 10-month old daughter was nearby, has been charged with eight felony and misdemeanor crimes, according to authorities and court documents.
Alejando Padilla, 20, was charged Wednesday with discharge of a firearm with gross negligence, two counts of possession of a machine gun, two counts of machine gun conversion and two counts of manufacture/sale of a multiburst trigger activator, all felonies. He was also charged with misdemeanor cruelty to a child by endangering health.
Padilla, who spent three days in a hospital before being booked at Santa Rita Jail on Tuesday, is being held without bail because of a probation violation. He is scheduled to be arraigned April 1.
According to court documents, Padilla shot himself in the leg just after 11 p.m. Friday inside his home in the 2700 block of East 9th Street. His 10-month old daughter was in the same room but was not injured, authorities said.
He shot himself with a pistol that had been converted from semi-automatic to fully automatic with a Glock Auto Sear device, authorities said. The device is a combination of parts designed to convert a weapon to shoot automatically more than one shot, without manual reload, by a single function of the trigger, authorities said. The gun he shot himself with had a bullet in the chamber and 12 rounds in a magazine, according to the documents.
During a search of the home, police found another converted semi-automatic pistol that did not have a serial number, the documents say.
Authorities said police also found tools used to convert the pistols as well as documents that appeared to be a record of people who had been sold guns illegally.
According to court documents Padilla is on three years probation after his conviction in October 2018 for misdemeanor evading an officer with willful disregard for public safety. He had been charged with that crime after his arrest in August 2018 and had also been charged with felony perjury by declaration and misdemeanor counts of being an unlicensed driver and false evidence of registration.
In a plea deal in October 2018, he pleaded no contest to the evading count and the other charges were dismissed. He was sentenced to six months in county jail and the three years probation.
