OAKLAND — A man has been charged with murder in a June fatal road rage related shooting of another man in East Oakland, according to authorities and court records.
Eduardo Galindo Garcia, 23, of Oakland is charged in the killing of Joseph Cox, 43, a father of five who was shot June 9. Cox, who had recently moved to Oakland from San Leandro, died at a hospital June 13.
The murder count carries a special circumstance allegation that it was a drive-by killing, according to court documents. Galindo Garcia is also charged with shooting at an occupied vehicle and possession of an assault weapon. He has denied being the gunman, authorities said.
Authorities said the shooting happened about 10:25 p.m. June 9 as the men, who did not know each other, were driving in separate cars eastbound on Foothill Boulevard. Authorities said the men got into some kind of dispute while driving that ended with Cox being shot in the 3800 block of Foothill and crashing into a parked vehicle.
Galindo Garcia lived near where the shooting happened. After reviewing video surveillance tapes from the area, police were able to identify and locate the vehicle he was driving at the time of the shooting, leading to him being identified as the suspect, Officer Jason Turner said..
He was arrested at his home on 38th Avenue Sept. 12 and formally charged Sept. 14. He is scheduled to enter a plea Oct. 4 and is being held without bail.
Authorities said they were told that Cox worked part time as an auto mechanic and also worked at a Hayward food company.
