Assault on BART female rider in San Leandro leads to criminal charge against man

SAN LEANDRO — An assault charge has been filed against a man suspected of throwing a beer can at a woman on board a BART train Friday night and then trying to push her from a San Leandro station platform onto the trackway, according to authorities and court documents.

The suspect, Ramon Torres-Pena, 27, of San Mateo, was charged Monday with misdemeanor assault with force likely to produce great bodily injury.

The victim, a  37-year-old Hayward resident, who did not know Torres-Pena, was riding a BART train on the Dublin/Pleasanton line about 8:30 p.m. Friday that was nearing the Bay Fair Station in San Leandro.

According to court documents, Torres-Pena, who appeared to be intoxicated, had been verbally harassing the woman on the train. When she tried to move to another car, he followed her and threw an open 24 ounce beer can at her,  the documents say. The woman was able to use her hand to block the can from hitting her in the face but suffered a finger injury that did not require hospitalization, authorities said.

According to the documents, Torres-Pena followed the woman off the train onto a platform when it stopped at the Bay Fair Station.  While the woman was walking about three feet from the edge of the platform, Torres-Pena forcibly shoved her toward the trackway that had an electrified third rail, but she was able to regain her balance preventing her from falling into the trackway, the documents say.

Torres-Pena was arrested by BART police at the station.  He initially refused to give his name or talk about the attack, the documents say.

He is being held in lieu of $60,000 bail at Santa Rita Jail and is scheduled to be arraigned in court Wednesday.
